Energy Performance Certificates

From 1 October 2008 it became a legal requirement for a landlord toprovide an Energy Performance Certificate (EPC) when renting out a building. This is defined as having a roof and walls and uses energy to condition the indoor enviroment, and has its own facilities that are not shared.


An EPC is not requird for a licensed HMO where facilities are shared. The Landlord remains responsible person to obtain an EPC even if an agent is used.

 

What does this mean in practice?

* An EPC is required whenever a home in the private rented sector is let to a new tenant.
* The EPC must be made available free of charge to prospective tenants at the earliest opportunity.
This should be when they are first given written information about the property or arranging to view it, andbefore any rental contract is entered in to.
* You must give a copy of the EPC to the person who takes up the tenancy.
* EPCs are valid for 10 years and can be reused as many times as required within that period.
* It is not necessary to commission a new EPC each time there is a change of tenant.
* If a newer EPC has been produced for a dwelling, it will always supersede an existing one.
* An EPC is not required for any property that was occupied prior to 1 October 2008 and which continues to
be occupied after that date by the same tenant.
